Bill 793/XVII approved in the general vote

Livre’s bill exempting from income tax the gain on selling your home when it is reinvested in a collectively owned housing cooperative passed its general vote on October 16, 2026.

Today the income-tax exemption on the gain from selling a permanent home applies only if the money is reinvested in buying another property. Livre’s bill extends it to reinvesting in the right to live in a home owned by a collective-ownership housing cooperative: the model in which the cooperative owns the homes and the member pays for the right to live in one, a property right granted by deed and registered. It does so by adding a paragraph to article 10(5) of the IRS code. The exemption is lost if that right is not entered in the land register, and a contract to acquire it joins those that pause the reinvestment deadline when the purchase is held up for reasons outside the seller’s control.

It would come into force the day after publication but take effect only with the following State Budget. It was debated together with IL’s Bill 712/XVII and, like it, still has to go through the detailed vote and a final overall vote.
